How Much Data Does Your Organization Hold?

Earlier this week Legaltech News announced the release of Conduent’s Viewpoint 6.0 eDiscovery platform with a data analytics focus. Why is this blog worthy (since we don’t typically offer unabashed plugs for our technology, Viewpoint being one of the platforms we offer?) Simply because the article highlights three salient trends in the legal market that are simply not going to disappear.

Trend #1: Even the best legal technologists may not know how much data their organization holds.

“Even if you’re able to venture a guess — and not every legal technologists can — chances are your estimate is actually too low.”

Millions of files can be stashed in loosely tracked and managed sources such as e-mail, social media, SharePoint, chat and other sites. Often, even the best technologists don’t have their arms around every media source used by the company and its employees. And, “bad” data can cost companies millions, in terms of risky data it should have gotten rid of according to records retention policies and schedules, costs associated with over-preserving non-relevant data, and the costs of not proactively identifying risky data and remediating it before an investigation or litigation hits.

Trend #2 (the corollary to trend #1):

“Organizing that data… is one of the greatest challenges in the modern legal department, leading to the trend of many e-discovery tools and platforms utilizing greater analytics.”

Law firms, in fact, can offer immense value-add in this regard. They are leveraging advanced analytical tools to cull, splice and dice, and organize data to provide ease and facility in promoting only the subset of data warranting review to their client – thus keeping review and processing costs as low as possible. Viewpoint integrates advanced analytical tools in its technology, including technology-assisted review, e-mail relationship analysis, near-duplication identification, e-mail redundancy and thread management, concept analysis, and visual index search term refinement for quick document reduction.

Another important organizational tool for law firms and their clients are visual reports and other visualization techniques. For example, in the latest version of Viewpoint, Viewpoint’s enhanced visual reports create interactive charts that allow users to manipulate and interact with data in custom workflows. Reports have a new interface through which users can choose column, line, pie, and other standard chart types to sort, filter, and group data on the fly. Users can export the generated chart or take a highly focused approach to zoom in on refined subsets of relevant data and build focused review sets for investigation purposes.

Trend #3 (also a corollary to trend #1): Data volumes are growing.

Duh. This means, however, that eDiscovery technology has to scale. Providing the ability to scale is one of the central tenants of Viewpoint design and development. This is reflected in the horizontally-distributed architecture of Viewpoint that allows clients to easily add additional processing power or storage as needed. In addition to the new features that are included in each Viewpoint release, each edition’s enhancements and refinements to existing features are scaled to ensure that the underlying Viewpoint technology is able to handle the largest of matters. During the development cycle, all new features are tested against a corpus of data containing more than 10 million records to ensure that those features will work accurately and efficiently against large volumes of data. Viewpoint has been road-tested against some of the largest data sets in the industry, including one single project that contained over 100 million document records.
